1.Acceptance of Terms
These Terms of Service (the "Terms") constitute a legally binding agreement between you ("you,""your,"or "User") and Gambet LLC, a Wisconsin limited liability company, doing business as Gambet ("Gambet,""we,""us,"or "our"), governing your access to and use of Gambet's websites, applications, competitions, tournaments, virtual currencies, payment and redemption functionality, communications, APIs, and related products and services (collectively, the "Services").
By creating an account, clicking to accept these Terms, entering a Competition, purchasing or using Gambet Coins, receiving or seeking to redeem Prize Coins, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all policies incorporated by reference. If you do not agree, do not access or use the Services. If applicable law gives you non-waivable rights, nothing in these Terms is intended to waive those rights.
2.Definitions
"Competition"means any chess match, head-to-head contest, tournament, event, bracket, or other skill-based contest offered through Gambet. "Gambet Coins"means non-redeemable virtual units made available for entertainment, participation, or platform use as described in the Gambet Coins section. "Prize Coins"means separate promotional or prize units that may become eligible for redemption only after satisfaction of all applicable requirements described in these Terms.
"Provisional Result"means any displayed game result, tournament placement, prize, balance, or credit that remains subject to verification, correction, reversal, Fair-Play Review, payment clearance, eligibility review, or other validation. "Fair-Play Review"means Gambet's integrity review process, which may include engine analysis, automated or artificial-intelligence-assisted anomaly analysis, behavioral and technical signals, and human review. "Restricted Jurisdiction"means any location in which Gambet does not offer some or all Services because of law, regulation, risk, licensing, payment restrictions, business considerations, or other requirements.
3.Eligibility and Jurisdiction
You may use cash-prize or redeemable-prize features only if you are at least eighteen (18) years old, have legal capacity to contract, are physically located in a jurisdiction in which the applicable feature is offered, and satisfy all other eligibility criteria communicated by Gambet. Gambet may establish a higher minimum age where required by law.
Eligibility is determined based on your physical location at the relevant time, not merely your residence, mailing address, citizenship, or account registration location. Gambet may use IP data, device signals, geolocation technology, identity information, payment information, and other lawful methods to assess eligibility. You must not use a VPN, proxy, emulator, remote desktop, GPS spoofing, location-masking technology, or any other means to circumvent geographic restrictions.
Gambet may add, remove, restrict, or modify jurisdictional availability at any time where reasonably necessary for legal, regulatory, payment, security, integrity, or legitimate business reasons. Access to the Services from a particular location does not constitute a representation that every feature is lawful or available to you.
Participation by highly rated players is at Gambet's discretion. A person holding or having held a recognized chess rating of 2600 Elo or higher (including equivalent over-the-board or online ratings, in Gambet's reasonable judgment) may participate in the Services only as Gambet expressly permits. Gambet may, in its sole discretion, allow, condition, limit, monitor, or refuse such participation, in whole or in part, for any legitimate business reason, including competitive balance, integrity, matchmaking quality, prize-pool protection, or verification of rating and identity. Playing or attempting to play while rated 2600 Elo or above without Gambet's permission is a violation of these Terms.
4.Account Registration, Security, and One-Person-One-Account Rule
You must provide accurate, current, and complete information and keep it updated. Unless Gambet expressly authorizes otherwise, each natural person may maintain only one Gambet account. You may not create or use multiple accounts, share or sell an account, permit another person to play through your account, use another person's identity or verification information, evade a suspension or restriction, or control accounts that purport to belong to other persons.
You are responsible for safeguarding credentials and for activity occurring through your account to the extent permitted by applicable law. You must promptly report suspected unauthorized access. Gambet may require credential resets, additional authentication, identity verification, or other security measures.
5.Nature of Competitions
Gambet offers competitions intended to be determined predominantly by participant skill, including chess knowledge, calculation, strategy, time management, decision-making, and execution. Gambet does not guarantee that a particular Competition will be legally classified in the same manner in every jurisdiction. Gambet may modify or discontinue Competition formats where necessary.
Assignment of White or Black, bracket placement, matchmaking, or other administrative elements may involve randomization. Such administrative randomization does not alter the requirement that Users comply with all Competition rules and eligibility restrictions.
6.Automated Systems, Testing, and Integrity Technology
Gambet may use automated systems, artificial intelligence, statistical models, chess engines, automated accounts, simulated play, testing environments, integrity-testing mechanisms, fraud-detection tools, and other automated technologies to operate, secure, test, improve, moderate, or evaluate the Services. Where Gambet deploys automated or computer-controlled opponents in circumstances in which disclosure is legally or contractually required, Gambet will provide such disclosure. Nothing in these Terms authorizes Gambet to make a materially false representation that a computer-controlled opponent is a human participant.
Automated systems may generate risk scores, flags, or recommendations. Gambet may use such outputs as one factor in an investigation or enforcement decision, but may also conduct additional automated or human review.
7.Gambet Coins
Gambet Coins are limited, revocable, non-transferable digital units licensed for use solely within the Services as Gambet permits. Except where expressly stated otherwise by Gambet, Gambet Coins have no cash redemption value, are not legal tender, are not money or a bank deposit, are not cryptocurrency, are not a security or investment product, do not accrue interest, are not insured by the FDIC or SIPC, and may not be sold, assigned, transferred, exchanged, or redeemed for cash or cash equivalents.
The purchase price or other consideration associated with Gambet Coins does not establish a cash redemption value. Gambet Coins represent a contractual license to access designated platform functionality and remain subject to these Terms.
8.Prize Coins and Redemption
Prize Coins are distinct from Gambet Coins. Prize Coins are contractual promotional or prize units recorded within the Services. Before all redemption conditions have been satisfied, Prize Coins are not cash, legal tender, a bank deposit, cryptocurrency, a security, or an immediately payable monetary obligation; they have no independently transferable cash value and may not be sold, assigned, pledged, transferred between Users, or exchanged outside the Services.
Subject to these Terms, an eligible Prize Coin that has fully satisfied all redemption conditions may be redeemed at the contractual redemption rate of one (1) eligible Prize Coin for one United States dollar (US $1.00). This redemption feature does not convert unverified, restricted, provisional, forfeited, reversed, or otherwise ineligible Prize Coins into cash before the applicable conditions are satisfied.
Redemption eligibility is conditioned on, as applicable, completion and verification of Competition results, Fair-Play Review, identity and age verification, geographic eligibility, payment clearance, tax information, fraud and security review, satisfaction of any applicable play or promotional requirements, compliance with these Terms, and any other lawful requirements disclosed by Gambet. The minimum redemption request is thirty-five United States dollars (US $35), unless Gambet publishes a different minimum as permitted by law.
After all applicable verification, review, and payment requirements are satisfied, Gambet ordinarily targets processing an approved redemption within one (1) to three (3) business days. This is an estimate, not a guarantee. Processing may take longer because of investigations, banking or processor delays, weekends or holidays, compliance requirements, incomplete information, extraordinary volume, or circumstances outside Gambet's reasonable control.
A displayed Prize Coin balance is a Provisional Result and is not an unconditional promise of payment until the applicable Prize Coins have become eligible for redemption under these Terms.
9.Deposits, Purchases, Payments, and Payment Authorization
You represent and warrant that you are authorized to use every payment method submitted to Gambet. You may not use stolen, unauthorized, fraudulently obtained, or improperly controlled payment credentials. Payments may be processed by third-party payment providers whose additional terms may apply. Gambet may establish transaction limits, payment holds, funding-source restrictions, verification requirements, or other controls. Gambet does not guarantee that any particular payment method will remain available.
10.Chargebacks and Payment Disputes
Nothing in these Terms prohibits you from exercising legitimate rights under applicable consumer-protection, billing-error, or payment-card laws. A legitimate payment dispute may include, as applicable, a transaction you did not authorize, a duplicate charge, an incorrect amount, or a qualifying failure to provide purchased goods or services as agreed.
If you initiate or cause a chargeback, reversal, payment dispute, or retrieval request concerning a transaction that you knowingly authorized, and after appropriate review the underlying obligation remains valid and payable, Gambet may, to the maximum extent permitted by law and applicable payment-network rules: suspend or restrict your account; restrict redemption; offset amounts otherwise payable to you; reverse associated credits; recover the unpaid amount; and recover reasonable, documented chargeback, processing, administrative, collection, or third-party costs actually incurred as a result of the improper dispute. Gambet may not impose a penalty merely because a User exercises a legally protected billing-dispute right in good faith.
11.Competition Entries, Results, and Provisional Settlement
Entry into a Competition constitutes acceptance of the rules displayed for that Competition together with these Terms. Unless expressly stated otherwise, all displayed results, placements, winnings, Prize Coin awards, and balance changes are Provisional Results until Gambet's verification processes are complete.
Gambet may correct scoring errors, duplicate credits, incorrect balances, erroneous tournament placements, misapplied prizes, system-generated errors, or results affected by cheating, collusion, fraud, technical defects, or rule violations. Where reasonably necessary, Gambet may reverse or adjust a Provisional Result and restore, reallocate, or refund affected amounts in accordance with the applicable Competition rules and law.
12.Fair Play and Prohibited Assistance
You must play every Competition yourself and without unauthorized assistance. Prohibited conduct includes, without limitation: use of chess engines or engine-derived suggestions; artificial-intelligence assistance; outside human assistance; screen-sharing for assistance; move relays; analysis tools prohibited by Competition rules; collusion; arranged outcomes; intentional losses; sandbagging; rating manipulation; smurfing; account sharing; multi-accounting; coordinated bracket manipulation; unauthorized automation; and any device, software, service, communication, or method used to obtain an unfair competitive advantage.
Attempting, conspiring, facilitating, instructing, or assisting another User to engage in prohibited conduct is itself a violation, whether or not the attempt succeeds.
13.Fair-Play Review and Evidence
Gambet may subject any Competition, account, transaction, or redemption to Fair-Play Review. Review may include one or more of the following: (i) chess-engine comparison and position-specific analysis; (ii) automated or AI-assisted detection of anomalies, move-time patterns, accuracy patterns, decision consistency, known cheating signatures, or other statistical signals; and (iii) human review.
In determining whether platform rules have been violated, Gambet may consider the totality of information reasonably available to it, including engine correlation, move quality, move timing, historical performance, historical playing style, rating trajectory, behavioral patterns, device and session information, linked-account signals, IP and geolocation information, transaction patterns, prior integrity flags, Competition context, automated-model outputs, and human expert review. No single metric is necessarily dispositive.
Gambet's internal platform-enforcement determinations need not satisfy a criminal burden of proof. They are administrative determinations concerning access to and integrity of the Services, subject to these Terms, applicable law, and the dispute-resolution procedures below.
14.Investigation Holds
If Gambet reasonably suspects cheating, collusion, fraud, payment abuse, account compromise, identity misuse, geolocation circumvention, exploitation of a defect, money laundering, sanctions concerns, or another material violation, Gambet may temporarily suspend or restrict account functionality and place a hold on withdrawals, redemptions, Prize Coins, prizes, transfers, or other affected amounts while the matter is investigated.
A temporary hold is not a final determination of wrongdoing. Gambet will endeavor to make investigation-related decisions within a commercially reasonable period, taking into account the complexity of the investigation, third-party dependencies, legal obligations, and security considerations.
15.Enforcement, Suspension, and Termination
To the maximum extent permitted by applicable law, Gambet may warn, restrict, suspend, disqualify, terminate, limit, or refuse service to an account, with or without prior notice, where Gambet reasonably determines that such action is appropriate because of a violation or suspected violation of these Terms, fraud, cheating, abuse, security risk, legal or regulatory requirements, threats to platform integrity, misuse of the Services, risk to Gambet or other Users, or other legitimate business reasons.
Depending on the circumstances and applicable law, remedies may include reversal of affected Provisional Results, disqualification, cancellation of affected entries, adjustment or forfeiture of Prize Coins or prizes attributable to prohibited conduct, reimbursement of affected Users, recovery of amounts improperly obtained, and permanent account termination. Gambet will not rely on this section as authority to confiscate unrelated, legally owed customer property arbitrarily.
16.Disconnects, Timeouts, and User-Side Technical Failures
Except where Gambet expressly determines that a verified material failure of Gambet's own systems warrants a different remedy, the User whose connection terminates, times out, or otherwise prevents completion of a Competition bears the risk of that interruption. A disconnect, device failure, local software failure, power loss, internet outage, network instability, operating-system issue, or other circumstance outside Gambet's systems may result in a loss, timeout, forfeit, or other result under the applicable Competition rules.
Gambet may void, refund, replay, reconstruct, or otherwise remedy a Competition affected by a verified material Gambet-side outage or defect, but is not required to provide a particular remedy where doing so would be unfair, technically infeasible, legally prohibited, or inconsistent with Competition integrity.
17.Collusion, Manipulation, and Competitive Integrity
You may not coordinate moves or results, intentionally lose, share unauthorized assistance, manipulate brackets or matchmaking, coordinate entries to obtain an improper advantage, play against yourself through multiple accounts, share prizes as part of a scheme to manipulate results, or otherwise interfere with legitimate competition. Gambet may analyze relationships among accounts, devices, payment methods, networks, gameplay, and transactions to identify coordinated activity.
18.Bugs, Exploits, Errors, and Unintended Benefits
You may not knowingly exploit, reproduce for improper benefit, conceal, or profit from a software defect, accounting error, pricing error, duplicate credit, incorrect Prize Coin award, security vulnerability, race condition, tournament defect, or other unintended behavior. You must promptly report material defects that you know are producing improper financial or competitive benefits.
Gambet may correct errors and reverse or recover amounts, Prize Coins, Gambet Coins, entries, prizes, or other benefits credited or obtained because of an error or exploit, to the extent permitted by law.
19.Identity Verification, KYC, Fraud Prevention, and Compliance
Identity verification is required before redemption unless Gambet expressly states otherwise. Gambet may also require identity, age, location, payment-ownership, source-of-funds, tax, sanctions, or other verification at any time reasonably necessary for fraud prevention, security, legal compliance, payment processing, or platform integrity.
Failure or refusal to complete required verification may result in restriction of redemption or other affected features. Gambet may use third-party verification providers and may retain or process verification records as described in its Privacy Policy and as permitted or required by law.
20.Taxes
You are solely responsible for determining and satisfying taxes arising from your use of the Services, winnings, prizes, or redemptions, except taxes imposed directly on Gambet. Gambet may request tax information, issue tax forms, report transactions, or withhold amounts when required by law.
21.Tournament Administration; Cancellation and Modification
Gambet may cancel, postpone, reschedule, restructure, pause, or void a Competition where reasonably necessary because of insufficient participation, technical failures, integrity concerns, suspected manipulation, force majeure, legal or regulatory developments, payment issues, or other circumstances materially affecting fairness or operation.
Gambet may determine an appropriate remedy, including refund, replay, bracket adjustment, prize reallocation, or cancellation, subject to applicable law and the Competition-specific rules. Entering, funding, or registering for a Competition does not guarantee that a particular opponent, bracket, tournament, prize pool, schedule, or feature will remain available.
22.Promotional Programs
Bonuses, free entries, referral rewards, promotional Gambet Coins, promotional Prize Coins, and similar benefits may be governed by additional terms, expiration dates, eligibility rules, play requirements, redemption restrictions, or geographic limitations. Promotional abuse, self-referral, coordinated referral schemes, multi-accounting, or artificial transaction activity may result in cancellation of promotional benefits and other enforcement.
23.Setoff, Negative Balances, and Recovery
To the maximum extent permitted by law, Gambet may offset amounts that you validly owe Gambet against amounts otherwise payable or redeemable to you, including amounts arising from reversed payments, improper chargebacks, duplicate credits, erroneous payments, fraud, or benefits obtained through prohibited conduct. You remain responsible for a valid negative balance. Gambet may use lawful collection methods to recover amounts properly owed.
24.No Interest; No Banking Relationship; No Fiduciary Duty
Except where applicable law expressly provides otherwise, balances associated with the Services do not accrue interest for you. Gambet is not a bank, broker, investment adviser, fiduciary, trustee, or financial adviser merely because it maintains records of Gambet Coins, Prize Coins, entries, prizes, or redemption eligibility. Nothing in these Terms creates a fiduciary relationship between Gambet and a User.
25.Unclaimed Property, Death, and Incapacity
Dormant balances and other property will be handled in accordance with applicable unclaimed-property and escheat laws. In the event of a User's death or incapacity, Gambet may require documentation reasonably necessary to identify a lawful representative or successor before releasing information or processing amounts legally due.
26.Prohibited Uses
You may not: interfere with or disrupt the Services; attack, probe, overload, or circumvent security controls; scrape or harvest data except as expressly authorized; reverse engineer or decompile software except where such restriction is prohibited by law; use unauthorized bots, scripts, automation, or APIs; impersonate another person; harass or threaten Users or personnel; use the Services for unlawful activity; launder funds; evade sanctions; manipulate payment systems; or assist another person in doing any of the foregoing.
27.Intellectual Property and Limited License
The Services, including software, designs, trademarks, logos, interfaces, databases, tournament systems, text, graphics, and other content supplied by Gambet, are owned by or licensed to Gambet and are protected by applicable intellectual-property laws. Subject to these Terms, Gambet grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose.
If you provide feedback, suggestions, or ideas, you grant Gambet a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate them without compensation or obligation, to the extent permitted by law.
28.Third-Party Services
The Services may depend on payment processors, identity-verification vendors, cloud providers, analytics providers, authentication services, geolocation vendors, communications services, or other third parties. Gambet is not responsible for third-party acts or omissions beyond the extent required by applicable law. Third-party terms and privacy practices may apply separately.
29.Electronic Communications and Records
You consent to receive agreements, notices, disclosures, transactional messages, and other legally permitted communications electronically. Electronic records, system logs, transaction records, gameplay records, timestamps, integrity-review records, and other business records may be maintained and used as evidence to the extent permitted by applicable law and applicable evidentiary rules.
30.Cooperation with Legal and Regulatory Process
Gambet may preserve, review, or disclose information where Gambet reasonably believes disclosure is required by law, subpoena, court order, valid governmental demand, payment-network requirement, or other binding legal process, or is reasonably necessary to investigate fraud, protect rights or safety, enforce these Terms, or defend legal claims, subject to applicable privacy law.
31.Changes to the Services and Regulatory Change
Gambet may modify, suspend, restrict, or discontinue features, Competition formats, virtual-currency functionality, fees, payment methods, jurisdictional availability, or other aspects of the Services. Where a change materially affects existing legal rights or obligations, Gambet will provide notice to the extent required by law.
If Gambet reasonably believes a legal, regulatory, licensing, payment-network, sanctions, or governmental development requires immediate action, Gambet may restrict affected features or jurisdictions without advance notice where permitted by law.
32.Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS"AND "AS AVAILABLE."GAMBET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT. GAMBET DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME, OR THAT ANY PARTICULAR OPPONENT, COMPETITION, PRIZE, REDEMPTION METHOD, OR FEATURE WILL BE AVAILABLE.
33.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAMBET AND ITS AFFILIATES, OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, REPUTATIONAL HARM, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMBET'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF FEES PAID DIRECTLY TO GAMBET BY YOU DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT TO THE EXTENT A DIFFERENT LIMIT IS REQUIRED BY APPLICABLE LAW. THIS LIMIT DOES NOT PURPORT TO LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
34.Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Gambet and its affiliates, owners, directors, officers, employees, agents, and service providers from third-party claims, damages, losses, liabilities, judgments, penalties, costs, and reasonable attorneys' fees arising from your unlawful conduct, fraud, misuse of the Services, violation of these Terms, infringement of third-party rights, or unauthorized use of another person's account, identity, or payment method. This section does not require indemnification to the extent prohibited by applicable consumer law.
35.Force Majeure
Gambet will not be responsible for delay or failure caused by events beyond its reasonable control, including internet or telecommunications failures, cloud outages, cyberattacks, labor disputes, acts of government, changes in law, war, terrorism, civil unrest, natural disasters, epidemics, power failures, payment-network outages, or failures of critical third-party providers, subject to obligations that applicable law does not permit Gambet to waive.
36.Informal Dispute Resolution
Before initiating arbitration or litigation, the claimant must send the other party a written Notice of Dispute describing the claimant's name and account information, the factual and legal basis of the dispute, the relief requested, and sufficient information to permit meaningful evaluation. Notices to Gambet must be sent to admin@gambet.gg and 2368 N 64th St, Wauwatosa, WI 53213.
The parties will attempt in good faith to resolve the dispute for thirty (30) days after receipt of a complete Notice of Dispute before commencing arbitration, unless applicable law requires a different procedure.
37.Mandatory Individual Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO GO TO COURT.
Except for disputes that applicable law prohibits from being arbitrated and any qualifying individual small-claims matter, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, your account, a Competition, payments, Prize Coins, redemption, enforcement decisions, or the relationship between you and Gambet shall be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under the AAA rules applicable to the dispute, including applicable Consumer Arbitration Rules, as modified by these Terms only to the extent such modification is permitted. The Federal Arbitration Act will govern the interpretation and enforcement of this arbitration agreement to the extent applicable.
The arbitrator may award relief available to the individual claimant under applicable law but may not award relief for or against persons who are not parties to the individual arbitration except where applicable law requires otherwise. Hearings may be conducted remotely, by telephone, on written submissions, or in person as permitted by applicable AAA rules and law. Nothing in these Terms requires physical travel to Alaska when the arbitrator, AAA rules, or applicable law permits a remote proceeding.
38.Class, Collective, and Representative Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND GAMBET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The enforceability and effect of this waiver will be determined under applicable law and the governing arbitration rules.
39.Coordinated or Mass Arbitration
If substantially similar arbitration demands are filed in a coordinated manner by or with the assistance of the same or coordinated counsel, administrator, organization, or funding source, the parties agree that applicable AAA mass-arbitration procedures may be used. Nothing in this section eliminates substantive rights or imposes a procedure inconsistent with mandatory AAA requirements or applicable law.
40.Jury-Trial Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOR ANY DISPUTE THAT PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND GAMBET KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY.
41.Governing Law and Alaska Forum
Except to the extent preempted by federal law or prohibited by a non-waivable law of another jurisdiction, these Terms and any dispute arising from them will be governed by the laws of the State of Alaska, without regard to conflict-of-laws principles. For any dispute that is not subject to arbitration and is not properly brought in small-claims court, you and Gambet consent, to the maximum extent permitted by law, to the exclusive jurisdiction and venue of the state or federal courts located in Alaska.
The parties waive objections based on personal jurisdiction, venue, or forum non conveniens to the extent such waiver is enforceable. Nothing in this section overrides a statutory venue, consumer protection, or other right that applicable law makes non-waivable.
42.Small Claims and Governmental Rights
Either party may pursue an eligible individual claim in small-claims court where permitted by applicable law and the governing arbitration rules. Nothing in these Terms prevents a User from reporting concerns to a governmental agency or regulator, cooperating with an investigation, or exercising rights that applicable law prohibits parties from waiving.
43.Assignment
You may not assign or transfer these Terms, your account, or your rights under the Services without Gambet's prior written consent. Gambet may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the Services, subject to applicable law.
44.Severability and Reformation
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and, where legally permitted, reformed to approximate its intended effect. The remaining provisions will remain in full force unless applicable law requires otherwise. Special severability rules may apply to the arbitration and class-action provisions under governing law.
45.Survival
Provisions that by their nature should survive termination will survive, including provisions concerning ownership, payment obligations, recovery and setoff, investigation records, disclaimers, limitation of liability, indemnification, dispute resolution, arbitration, governing law, and enforcement of accrued rights.
46.No Waiver
A failure or delay by Gambet to enforce a provision does not waive Gambet's right to enforce that provision later. Any waiver must be express and authorized.
47.Entire Agreement and Order of Precedence
These Terms, together with the Privacy Policy, Competition-specific rules, promotional terms, and other policies expressly incorporated by reference, constitute the entire agreement between you and Gambet concerning the Services. If Competition-specific terms conflict with these Terms, the more specific terms will govern the specific Competition unless they expressly state otherwise or applicable law requires a different result.
48.Amendments
Gambet may amend these Terms from time to time. Material changes will be communicated in the manner and with the advance notice required by applicable law. Continued use after an amendment becomes effective constitutes acceptance where legally permitted. If applicable law requires affirmative consent to a particular amendment, Gambet will seek it.
49.Contact Information
Operator: Gambet LLC, doing business as Gambet. Legal address: 2368 N 64th St, Wauwatosa, WI 53213. Support: admin@gambet.gg. Legal notices: admin@gambet.gg.
50.Website Policies, Linked Rules, and Clickwrap Assent
The Privacy Policy, Fair Play Rules, Competition Rules, Eligibility rules, promotional terms, and other policies expressly identified by Gambet may be incorporated into these Terms by reference. Where a specific Competition or promotion has additional rules, those rules apply in addition to these Terms.
Gambet may require affirmative assent to these Terms and incorporated policies through an unchecked checkbox, button, or comparable clickwrap mechanism during account creation, before a User first enters a paid or prize-bearing Competition, after a material amendment, or at another appropriate point. Gambet may maintain electronic records of the version accepted, timestamp, account, IP address, device/session information, and other evidence of assent to the extent permitted by law.
51.Privacy, Cookies, Analytics, and Device Information
Gambet's collection, use, retention, and disclosure of personal information is governed by its Privacy Policy and applicable law. The Services may use cookies, local storage, SDKs, analytics, fraud-prevention technology, geolocation technology, device identifiers, and similar technologies for authentication, security, preferences, analytics, legal compliance, and platform integrity. Where consent is legally required for a particular technology or purpose, Gambet will seek such consent.
52.Account Closure and Deletion Requests
Users may request account closure through the method provided by Gambet. Closure or deletion requests do not require Gambet to erase information that Gambet must or is permitted to retain for legal compliance, fraud prevention, dispute resolution, accounting, tax, security, enforcement, chargeback defense, responsible recordkeeping, or protection of legal rights. Account closure does not extinguish valid payment obligations, pending investigations, chargebacks, disputes, or provisions that survive termination.
53.Hyperlinks and External Websites
The Services may contain links to websites, applications, or services operated by third parties. A link does not constitute endorsement, control, or responsibility for the third party. Users access third-party services subject to the third party's terms and privacy practices. Gambet is not responsible for third-party content, availability, security, or conduct except to the extent applicable law provides otherwise.
54.Accessibility and Support
Gambet intends to provide reasonable channels for Users to report accessibility barriers, account problems, payment issues, security concerns, or other support matters. Users may contact admin@gambet.gg. Nothing in this section creates a warranty that every feature will be compatible with every assistive technology, device, browser, or operating system.
55.Security, Abuse, and Preservation of Integrity
Users must not attempt to bypass rate limits, authentication, anti-cheat controls, fraud controls, access restrictions, or technical safeguards; introduce malicious code; interfere with another User's access; test vulnerabilities without authorization; or use the Services in a manner reasonably likely to damage, disable, overburden, or impair Gambet systems. Gambet may take proportionate technical measures to protect the Services and preserve evidence of suspected abuse.
56.Notices to Users
Gambet may provide notices through the Services, account interface, email address associated with the User's account, or another legally permitted electronic method. Users are responsible for maintaining a current email address and reviewing material notices. Notices are effective as provided by applicable law and the applicable notice.
57.No Professional Advice
Information made available through Gambet concerning competitions, eligibility, payments, taxes, security, fair play, or other subjects is provided for operation of the Services and does not constitute legal, tax, investment, accounting, or other professional advice to a User.
